Terms of service

These terms govern your use of Upbuild, a hosted MCP connector operated by Madtechers SLU (Barcelona, Spain) with operational support from Uptimal FZCO (Dubai, UAE), together "Uptimal", "we". By connecting or using Upbuild you accept these terms on your own behalf or on behalf of the organization you represent.
1. The service
Upbuild lets you query advertising and analytics accounts you already have access to (Google Tag Manager, Google Analytics 4, Google Ads, Campaign Manager 360, Display & Video 360 and Meta Ads) from MCP-compatible AI assistants. All tools are read-only. The service depends on third-party platforms and assistants we do not control; their availability, quotas and terms apply to your use of them.
2. Accounts and access
You connect with your own Google (and optionally Meta) credentials via OAuth. You are responsible for having the right to access the accounts you query and for complying with the terms of the platforms involved. You must not share a single connection across people; each user connects individually.
3. Free trial
Each user gets one 30-day free trial. It starts on the first tool call and requires no payment method. When it ends, continued use requires an active subscription.
4. Subscriptions and billing
Plans are billed monthly in USD through Stripe (EUR display may be offered at checkout). Entitlements are enforced per tool call. You can subscribe, change plan, update payment details or cancel at any time through the Stripe customer portal, reachable from the chat via the billing tool. Cancellation takes effect at the end of the current billing period. Prices may change with reasonable prior notice; changes apply from the next renewal. Taxes may be added where required.
5. Acceptable use
- No attempts to circumvent entitlements, rate limits or trial limits.
- No use that violates law, the rights of others, or the terms of Google, Meta, Anthropic, OpenAI or your assistant provider.
- No probing, scanning or disrupting the service, and no automated bulk extraction designed to replicate the underlying platform APIs at scale.
- Fair use of shared API quota; we may offer dedicated quota options for high-volume needs.
6. Your data
How we handle personal data and platform data is described in the privacy policy. In short: read-only scopes, encrypted token storage, brief caching, no model training, no resale.
7. Intellectual property
Upbuild, its software, branding and documentation remain the property of Uptimal. Your platform data remains yours. Third-party names (Google, Meta, Claude, ChatGPT, Supermetrics and others) are trademarks of their respective owners; Upbuild is not affiliated with or endorsed by them.
8. Availability and changes
The service is provided "as is" and "as available". We may update, add or remove tools and features, and may suspend access to protect the service or comply with platform requirements. We aim for high availability but do not guarantee uninterrupted operation, and we are not responsible for outages or changes in third-party APIs and assistants.
9. Liability
To the maximum extent permitted by law, Uptimal is not liable for indirect, incidental or consequential damages, loss of profits, or decisions taken on the basis of data returned by the service. Our total aggregate liability is limited to the fees you paid for the service in the twelve months preceding the claim. Nothing in these terms excludes liability that cannot be excluded by law.
10. Termination
You can stop using the service and disconnect at any time. We may suspend or terminate access for breach of these terms, non-payment, or where required by a platform or by law. Sections that by their nature should survive (including 6, 7 and 9) survive termination.
11. Governing law
These terms are governed by Spanish law. Disputes are subject to the courts of Barcelona, Spain, without prejudice to mandatory consumer protections that may apply in your place of residence.
